Terms and Conditions Version 4.9 15th December 2016
It is important that you read these terms and conditions carefully before accepting the agreements. We recommend that you print and retain these terms and conditions, any confirmation emails, transaction details, additional offer terms and game rules for your records.
ACCEPTANCE OF TERMS AND CONDITIONS
You accept to be bound by this contract by clicking on ‘Submit’ or ‘I Agree’ or ‘Accept’. After clicking on ‘Submit’ or ‘I Agree’ or ‘Accept’, a legally binding agreement on these terms and conditions is concluded between, (a), you the end user (‘you’) and, (b), DR Vegas, and CZ Trading Ltd (Malta C41790), operating in Malta under the rules and regulations set by the Malta Gaming Authority (MGA) and where applicable players from the UK will be governed by the rules and regulations of the UK Gambling Commission.
Dr Vegas is the trading name of CZ Trading Ltd, a company registered in Malta (No: C41790). Our head office is situated at 35, Mannarino Road, Birkirkara BKR 9080, Malta. CZ Trading Ltd holds a Class 1 License CL1/370/2009 issued on 24th November 2009 granted by the Malta Gaming Authority (MGA). Players benefit from the security and peace of mind afforded by this Tier 1 gaming jurisdiction - Malta is the leader in remote gaming regulation, and is a full European Union member state.
Please note that these terms and conditions will prevail in the event of any conflict between these terms and conditions and any other document referred to in these terms and conditions.
Any substantial amendment to Terms & Conditions shall be notified in advance by DrVegas to the Account Holder and the player must re-confirm acceptance, before changes come into effect.
1 PROHIBITED PERSONS
You must be at least 18 years old to register and this site. It is an offence to play on this site if you are below this age. If the territory from which you are playing requires you to be older than 18, then you must be at least the minimum age specified by the applicable local laws. It is the responsibility of each player to know whether gaming is legal in their country. We may request additional information to confirm a player's age at any time. Any player found to be under the minimum age will have their account frozen and their winnings will be null and void. CZ Trading Ltd may be obliged to forfeit balances relating to accounts of someone under the minimum age to the Licensing Authority. No claim shall lie against CZ Trading Ltd in the event of account closure and/or the balance being remitted to the Licensing Authority or other authorised governing body in these circumstances.
The following countries are specifically prevented from registering: Afghanistan, Albania, Australia, Azerbaijan, Belgium, Bulgaria, China, Croatia, Czech Republic, France, Hong Kong, Hungary, Iran, Iraq, Ireland, Israel, Italy, Japan, Latvia, Malaysia, New Zealand, Norway, Portugal, Romania, Russia, Serbia, Singapore, South Africa, South Korea, Spain, Sudan, Switzerland, Thailand, Turkey, Ukraine and the United States of America. We reserve the right to ask you to prove your age and we may suspend your account until we receive satisfactory proof of your age. Any use of our services is at your sole option, discretion and risk.
DR Vegas reserves the right, at its absolute discretion, to refuse to register any player. Only one active account is allowed per player, any additional accounts will be closed. DrVegas reserves the right, at its sole discretion to close any player account, and in which case the contractual obligations will still be honoured. However DrVegas also reserves the right to notify such instance to the respective authority. It is prohibited for players to sell, acquire or transfer their account to any other player or individual.
Player must register in person and not through third parties. Please note, it is the responsibility of the player to ensure that their personal information and account are kept up to date.
DR Vegas retains the right to suspend or terminate a player’s account without prior notice in the event that, in our opinion, any of the Terms and Conditions are breached.
A player may close their account at any time by either going to their ‘My Details‘ page, blocked account and selecting how long to block the account or contacting the Customer Care team via IM or Email and requesting the permanent closure of their account. If the player chooses to Quarantine their account then it will be permanently suspended from use.
4 UNFINISHED GAMES
In the event that a player does not finish a game before logging out, then the player is required to finish the game the next time he/she logs on. All unfinished games will lapse after a period of 14 days and stakes will be credited to the DR Vegas account.
5 WITHDRAWAL AND CASH LIMITS
5.1 DR Vegas reserves the absolute right, where appropriate, to require players to supply additional personal details prior to them making a withdrawal. DR Vegas reserves the absolute right to be the sole arbiter in whether or not this right is invoked. The requirement is intended to, within reasonable bounds, protect the company from fraudulent / illegal dealings and / or transactions. You accept and agree to furnish any personal details on request and these may include true copies of your birth certificate, copies of driving licences, copies of passports, etc. This list is not exhaustive and may be amended at the discretion of DR Vegas. This will particularly, but not exclusively, apply to players with large first time cash-ins. The maximum payout for Mayan Treasure will be set at £ 50,000.
Under no circumstances will deposits made, once processed, be refunded without adhering to the minimum wagering requirements. All deposits are accepted in good faith and are subject to the specific bank's processing criteria. Transactions made by players using a third party’s debit or credit card will be accepted provided they meet the processing criteria. Deposits will, in these cases also be non-refundable. Transfer of funds between player accounts is prohibited.
5.2 In the event of players winning significant amounts, (the interpretation of significant to be at the discretion of DR Vegas) cheques may be payable. Players explicitly authorise DR Vegas to use their surname, first name and photograph and to additionally mention the name of the city and country where they reside. DR Vegas also reserves the right to present such cheques in person. These particulars can be used in any promotion or advertising in the United Kingdom or abroad, for two (2) years. The use for these elements by DR Vegas will be free of any payment or remuneration, other than the payment of the player’s winnings.
5.3 Playing accounts are for gaming purposes only and should not be treated as a financial instrument and do not gain/earn interest. If there is any attempt to use a playing account as a financial instrument, or any suspicious transactions occur (including, but not limited to, large scale deposits and withdrawals relative to level of gaming activity) then DR Vegas reserves the right to suspend the account indefinitely. DR Vegas also reserves the right to notify the relevant law enforcement bodies with the details of the suspicious transactions.
Players are not permitted to load their account when there are already sufficient playing funds in the account. Players should note that they are free to set their own Weekly Deposit Limits, Session Play Limits and Session Loss/Wager Limits. Reduction in any limits will be implemented immediately. Any increase and/or revocation of limits comes into effect after a 7 day cooling off period.
During the ‘Cooling off’ period players will still be allowed to play providing within the parameters of the set limits. In the event that no limit is set the system will default to its own limits over a seven day period.
As part of its Responsible Gambling policy and as requested by the relevant authorities, DrVegas offers the option to ‘block account’ for a period between one week to a month, and/or self-exclusion between six months to twelve months. Should a player want to exclude him/herself for a longer period, he/she would have to notify DrVegas’s Support personnel via chat/email. During the period of self-blocking or self-exclusion, the player account will be inaccessible.
5.4 Banking rules prohibit the payment of winnings back to Non - U.K. Mastercards, UK Mastercard Debit cards and payments will therefore in these instances be made by way of cheque, written out to the registered account holders details and sent to their registered address. In the case of U.K Mastercard, Maestro, Solo, Visa credit, Visa/Delta, Electron and Non U.K. Visa cards monies will, in these instances, be returned to the card used to make the last deposit. In case of Skrill and Neteller monies will be returned to the account used to deposit. Please note that, due to card rules, the maximum withdrawal, by way of Non U.K. issued Visa cards, U.K. Visa/Delta and Electron cards, is limited to 2500 GBP in any one 24 hour period. Where a cheque or a Non - U.K. Mastercard or UK Mastercard Debit card is the last method used as a playing deposit, withdrawals will be made by way of cheque. Please note, we do not charge to withdraw from your account and we accept no responsibility for any charges or fees applied by your issuing bank or financial institution. Withdrawals to Skrill and Neteller will be approved at a rate of £500 per day per player.
5.5 The company reserves the right to restrict a player from making their first withdrawal (after registration) until such time as they have spent the minimum required cash spend. More details are available from the withdrawal page.
5.6 It is unlawful to deposit, or attempt to deposit funds obtained from ill-gotten gains. DR Vegas will check all deposits made by any individual player, and if we determine or suspect that a transaction is suspicious, DR Vegas reserves the right to freeze the suspicious account and the relevant funds held within, until such time as appropriate identity checks are carried out. DR Vegas will report any suspicious activity to the Malta Gaming Authority (MGA), and where necessary other law enforcement bodies. Additional identity checks will be carried out on any player attempting to withdraw sums in excess of £1,500 in order to comply with Anti Money Laundering regulations.
5.7 In the event that a Player Account has not been accessed (logged in to) for thirty months, DR Vegas reserves the right to close the account. DR Vegas will attempt to contact the player and return all funds. If this proves unsuccessful, all bonuses will be removed from the account, a 10% administration charge will also be applied before the remaining balance is remit to the Malta Gaming Authority (MGA). No claim shall lie against DR Vegas in the event the balance is remitted to the Malta Gaming Authority (MGA) in these circumstances. To retrieve balances held by the MGA players should contact DR Vegas who will liaise with the MGA for the return of the balance. Inactive Account means a Player Account which has not recorded any log in or log out for a period exceeding twelve (12) consecutive months. If your Player Account is deemed to be inactive, Dr Vegas reserves the right to charge a monthly administrative fee of EUR 5 or the equivalent in another currency (or the current balance of your Player Account, if less) as long as the balance of your Player Account remains positive. You authorize Dr Vegas to debit this fee from your Member Account on the beginning of the month following the day on which your Player Account is deemed inactive, and on the beginning of every subsequent month that your Player Account remains inactive. Dr Vegas will stop deducting the fee if the account balance is zero or if the account is re-activated.
5.8 Acceptable methods for Players to Deposit funds are Visa Credit International, Visa Credit, Skrill, paysafecard, Neteller, MasterCard, MasterCard International, Maestro, Switch, Maestro Dom, Visa and Visa Debit (Delta) subject to all other Terms & Conditions contained herein.
Players can also Deposit using Solo or Electron cards but not for a first deposit.
Players can withdraw using: Neteller, Skrill, Visa Credit International, Visa Credit, MasterCard, MasterCard International, Maestro, Switch, Maestro Dom, Visa, Visa Debit (Delta), Solo or Electron subject to all other Terms & Conditions contained herein.
Withdrawals will be paid by Cheque for players that currently deposit using MasterCard International, UK Mastercard Debit and paysafecard, if they ask for a cheque instead of using a 'my paysafecard' account.
Where Deposits are Authorised by the Issuing Bank the debit will normally take affect on the Players Account within 24 hours.
Where Withdrawals are Authorised the credit to the player bank account will be dependant upon the bank processing timeframes which normally take less than 10 days. CZ Trading cannot be held liable for delays originating from the prevailing banking infrastructure.
5.9 The maximum number of withdrawals permitted within a 24 hour period will be 3. Additional withdrawals attempted within the 24 hour period will not be processed and players will be notified in the withdrawals page when their next withdrawal can be made. Players with a VIP status will be exempt from this restriction.
5.10 DrVegas reserves the right, at its sole discretion, to refuse or limit any wager you place.

7 GAME RULES
7.1 DR Vegas will make all reasonable endeavours to inform registered players of any changes to specific game rules and limits before implementing them. DR Vegas advises that a player should still read the game rules each time they play a game in case a rule has been changed.
7.2 All progressive jackpots increment in real time and with every play. When playing a game for cash, with a progressive jackpot, the jackpot value displayed in the game will be correct at the point in time that the game is played. However, as the game is played by many players simultaneously the value may then go up (as more games are played) or down (as prizes are won) in real time. In the unlikely, but theoretically possible, event that more than one player wins the jackpot at precisely the same time then the prize will be shared equally. All payouts on progressive jackpots will be subjected to post game analysis and review before payment is made. The visual display of the progressive jackpot is shown instantly when the game is loaded and adjusted at every subsequent play. The games Swamp Rat, Rich Pickings and The Great Race have a different visual display of the jackpot - this is through an animation which scrolls up to the highest amount of the jackpot at the time of play, and which re-adjusts the jackpot at every play.
7.3 Any game malfunction voids all pays and plays.
7.4 Please note CZ Trading will not be held liable for inaccurately advertised jackpots (either externally, on the site or via a game). In the event of an inaccurate jackpot being won, the winning amount will be held while an investigation is taken place and the correct amount will then paid out. The decision of CZ Trading will be final.
7.5 Any attempt by a player (in the opinion of CZ Trading Ltd) at collusion, manipulation of game outcomes, to intentionally bypass the site security, to use automated tools to attack this website or use this website to attack other websites (e.g. by use of BOTS or other malicious software) may result in the player's account being closed and the player being reported to the relevant authorities.
8.1 Available tournaments are displayed in the tournament section.
8.2 The tournament is a time based game and requires a player to play during the specified tournament time. There will be no refunds for players who buy into a tournament and do not play the tournament.
8.3 The tournament end time is the final time. If a player still has game time remaining this will be nulled.
8.4 Prizes will be awarded within one minute of the tournament ending.
8.5 If two players have the same number of points at the end of the tournament, the final position will be decided by the entry date and time into the tournament.
8.6 If a player has 0 points at the end of a tournament, they will not be displayed in ’See result’ section and no prizes will be awarded to the player.
8.7 As soon as the spin button is first pressed within the game, the allotted time begins and this cannot be paused or restarted. If a player leaves the game the time will continue count down.
8.8 If a steal is awarded during the game, a player may steal from 5 players positioned above in the ranking list, or, if the player is in the top 5 positions, from those positioned below in the list as well.
8.9 As Tournaments are a Time Critical product, it is the Player's responsibility to ensure they have sufficient speed and network performance to ensure they can play the Tournament without being at a disadvantage.
9 COMPUTER VIRUSES
DR Vegas does not guarantee that files are free from computer viruses. It is the player’s responsibility to protect their systems and have in place the ability to reinstall any data or programs lost due to a virus.
We will make reasonable endeavours to provide access to the DR Vegas helpdesk by way of email and Live Chat 7 days a week. You can email us at email@example.com, or alternatively telephone on +44 (0) 1908 299343 from 9am to 5pm Monday to Friday (excluding Bank Holidays).
11.1 DR Vegas will pay relevant betting tax and gaming duty to the relevant tax authorities at the then applicable current rate.
11.2 You are responsible for the declaration and payment of any taxes as required by the jurisdiction in which you reside
12.1 It is your responsibility to ensure that your password remains known only to yourself.
12.2 All bets placed using a correct and current password will be deemed valid and effective. DR Vegas will carry out no further investigation into the identity of the player placing the bet.
12.3 If you know or suspect that any other party is aware of your password you must immediately contact DR Vegas to change your password. You will be asked to confirm the challenge question and answer that you provided when initially registering.
12.4 You are liable for any losses incurred on your account through transactions carried out using your password.
DR Vegas makes no warranties with respect to system malfunction and in the case of a malfunction all pays and plays are void.
YOUR ATTENTION IS IN PARTICULAR DRAWN TO THE PROVISIONS BELOW:
13.1 The following provisions set out the entire financial liability of DR Vegas (including any liability for the acts or omissions of its employees, agents and sub-contractors) to you in respect of:
13.1.1 any breach of this Agreement; and
13.1.2 any representation, statement or tortuous act or omission including negligence arising under or in connection with this Agreement.
13.2 All warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from this Contract. Your statutory rights are unaffected. DR Vegas does not warrant that the Website will be available at any particular time or location nor that it will be free of any viruses nor that its contents are accurate, reliable or correct.
13.3 Nothing in this Agreement excludes or limits the liability of DR Vegas for death or personal injury caused by DR Vegas’ negligence or its liability for fraudulent misrepresentation.
Subject to sub-clauses 11.1 and 11.2 above.
13.4 DR Vegas’ total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation or otherwise, arising in connection with the performance or contemplated performance of this Agreement shall be limited to £100.
13.5 DR Vegas shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this Agreement.
14 INTELLECTUAL PROPERTY
All intellectual property rights including without limitation copyrights, design rights and trade marks in the characters and graphics depicted in the games and elsewhere at www.drvegas.com vest in CZ Trading Limited and or licensors and their reproduction is not permitted without the express prior written permission of CZ Trading Limited.
15 DATA PROTECTION
CZ Trading is registered with the Malta Data Protection Commission (Reg. Ref. 9538) and adheres to the Data Protection Act, other relevant regulations, legal notices and/or similar at the Place of the Contract taking account of the Data Protection Directive (EC Directive 95/46/EC) and the Electronic Communications Privacy Directive (EC Directive/2002/58/EC. Furthermore, CZ Trading has adopted best practice when it comes to the principles of e-mail communication with Account Holders. All the aforementioned is in place in order to assure Account Holders that at all times personal data is:
- processed in accordance with the rights of the Account Holder concerned;
- processed fairly and lawfully;
- obtained only for a specific and lawful purpose;
- adequate, relevant and not excessive to its purpose;
- accurate and updated;
- kept in a secure manner;
- not kept longer than is necessary for its purpose;
- not transferred to jurisdictions not adhering to the aforementioned Directives; and
- is utilised for marketing purposes based on the so called opt-in principle, whereby the Account Holder should they wish not to receive any communications from associated third parties to CZ Trading Limited, should notify in writing to firstname.lastname@example.org.
CZ Trading Ltd may share Player Name, Gender, Date of Birth and Address information with marketing companies, consultancies and other service providers for the benefit of analysis to better enhance the games and services offered to players. The supply of personal data to third parties is on an opt-out basis.
In order to provide the gaming services the following roles within the organisation may have access to Player Data: Customer Care, Marketing and Senior Operations Staff.
16 FORCE MAJEURE
DR Vegas shall not be liable to you for any delay or non-performance of its obligations under this Agreement arising from any cause or causes beyond its reasonable control including, without limitation, any Act of God, Governmental Act, fire, flood, explosion or civil commotion.
17 JURISDICTION, REGULATION and DISPUTES
This Agreement is governed by the laws of Malta and the parties submit to the exclusive jurisdiction of the Courts of Malta. All amounts waged on DR Vegas will be deemed to have been wagered and accepted in Malta. CZ Trading Ltd (Malta C41790) is licensed (license no. MGA/CL1/370/2007) to operate a Class 1 license under a Class 4 platform operated by and licensed to Cyberslotz Services Limited (Malta C41791) (license no. MGA/CL4/269/2007) and regulated by the Malta Gaming Authority (MGA). Live Casino is operated through GM Ltd with a Class 1 on 4 no MGA/CL1/420/2007 of Medialivecasino Ltd. UK players will be governed by the UK Gambling Commission. CZ Holdings Ltd is approved to operate in the UK under license number 000-038168-R-319349-001. The MGA is the single public regulatory body that is responsible for the governance of all forms of gambling in and operated from Malta.
Where there is a dispute concerning a player’s account, DR Vegas reserves the right to suspend the player’s account until the dispute is resolved. Any dispute must be lodged by email to email@example.com with details and times of the dispute. DR Vegas takes disputes very seriously, and endeavors to take all reasonable action to investigate and resolve all disputes. If a player is still not satisfied, they have the right to bring the dispute to the attention of IBAS (firstname.lastname@example.org), or the regulatory body, the MGA (email@example.com). For UK based players IBAS will be the final arbitrator, for non UK based players the MGA will be the final arbiter.
No delay by DR Vegas in enforcing its rights under this Agreement will prejudice its rights and, in any event, will not be deemed to be a waiver of any other right or later breach.
You agree that any variation made to this document by DR Vegas will be binding.
If any part of this Agreement is held by a court of competent jurisdiction to be illegal or unenforceable for any reason then the validity of the remainder of the Agreement will not be affected.
This Agreement is personal to DR Vegas and you must not without the prior written consent of DR Vegas assign, transfer, charge or deal in any other manner with this Agreement or DR Vegas’ rights under it, or part of it, or purport to do any of the same, nor sub-contract any or all of your obligations under this Agreement.
22 THIRD PARTY RIGHTS
You agree to indemnify and hold us and our associated companies, affiliates, officers, directors, agents and employees harmless from any liabilities, claims, losses or demands made by any third party arising out of your breach of this Agreement including documents incorporated by reference into this Agreement or out of your violation of any law or the rights of any third party.
23.1 This Agreement between you and DR Vegas is the entire agreement between you and DR Vegas and supersedes any other oral or written communications, agreements or representations provided that neither party excludes any liability for any fraudulently made representation or warranty.
23.2 Words importing the singular include the plural, words importing any gender include every gender and words importing persons include bodies corporate and unincorporated and in each case vice versa.
Notices sent by either party under this Agreement must be sent by first class mail or by facsimile or by email transmission. Correctly addressed notices sent by first class mail shall be deemed to have been delivered 72 hours after posting whilst notices sent by facsimile or email shall be deemed to have been received within 2 hours of sending provided, in all cases, that the time for service falls on a normal working day in England and Wales. If not, then receipt shall be deemed to take place at 10 am on the next working day.
25 UK Gambling Commission - Secured Player Funds
We are responsible for the protection and management of your account balance. We safeguard all Member account balances (including, but not limited to, winnings) in a separate bank account that is independent from all of our corporate and operating accounts, and as such the account is held on trust for our players. Consequently, in the event of our insolvency, while protection of your funds is not absolutely guaranteed, you would be entitled to claim monies from this account. Such protection meets the medium rating standard in accordance with the ratings system set out by the Gambling Commission of Great Britain. These Terms and Conditions were last updated on the 15th December 2016, (Version 4.9) and supersede any previous Terms and Conditions.
